Justice Not Served in Assult Against Two Gay Men in Utah

In the early morning hours of July 4, 2008, a small mob of drunken men broke into the home of David James (DJ) Bell and Dan Fair in South Salt Lake City, Utah. These men had been sent to DJ and Dan's home by their neighbor Lulu Latu. Who was having a party at her house well into the early hours of the morning. In fact JD Bell had been attending the party earlier that evening.
Two children from that Latu house had gone over to the Bell/Fair residence for unknown reasons. There are different accounts of what when the mother found them next door. Infact the mother's own story has changed from when she gave her statement in July of 2008 and what she delievered in court on September 21st. Her party going friends andf family went next door and broke the door and several windows in. They proceeded with their act of vigilantism style of justice and beat Bell and Fair with house hold objects including a frying pan and a television set.
The beating was so severe that it has required Fair to have reconstructive surgery on his eye socket. The South Salt Lake City Police arrived on the scene from a 911 call placed by a friend that had been staying with Bell and Fair that evening. The SSLPD Officers found the two gay men beaten. Then then accused them of kidnapping the two and four year old neighbor children. The Police did not ask any questions and still to date have not filed any charges against the assailants. The South Salt Lake Police did not interview Bell and Fair's friends that were in the home at the time of the assault.
What the South Salt Lake Police did do was arrest DJ Bell, and then charge him with two counts of attempted kidnapping. After DJ was arrested and Dan taken to the hospital a friend of theirs was yelled at by a member of the assaulting party, "we hope your friend dies, and if he doesn't we're going to come back and finish the job!" in the presence of two officers. When their friend asked the officers, "Are you hearing this? Are you going to do anything about it?" they replied with a shrug and walked away.
Despite the many calls for justice to the South Salt Lake Police and the Salt Lake District Attorney's office, the only charges in this incident have been filed against Bell. The Jury was selected on Monday, September 21st . The trial started on Tuesday, September 22nd with strong opening statements. The trial then opened with a very inconsistent testimony from the children's mother, Lulu Latu that still has not explained why her children were not at home after midnight. Tuesday, September 23 followed with testimony from Latu's husband and other family members that don't recall what happened after they went next door.
Protests have been launched each morning of the trial from 8:00am to 9:00am before the start of the trial.
