“That is not necessarily the case regarding the evidence would be elicited in a military commission, elicited from detainees and terrorist as a result of enhanced interrogation techniques. It is not clear to me at all, that that information would necessarily be admitted in a military commission or that it would with stand a pellet scrutiny and on the basis of that concern and other things my desire to go to an article 3 court and minimize that kind of information and evidence and thought it was paramount.” - Eric Holder

Military Tribunal or Federal Court

•Afghanistan did not declare war on the United States.
•There is division in the Al-Quad and not all of them are terrorists.
•911 was an act of terrorism and not an act of war.
•The Supreme Court has already rejected a military tribunal under the Bush administration.
•Eric Holder made the choice and not the Obama administration.

The best chance to obtain a valid conviction of Khalid and any other terrorist or criminal for the U.S. and the rest of the world is in the U.S. Federal Courts and not a quick guilty conviction in a Military Tribunal.

Q. Why did the Bush administration call it the War on Terror.
A. For war time powers and the Iraq invasion was a valid war, the Iraq war.

Q. Who benefits from an invalid conviction in a Military tribunal?
A. The terrorists and the Republicans or War-Mongers.

The Terrorists use injustice or an invalid conviction for propaganda and recruiting.

The War-Mongers benefit from the increase in terrorism and increased threats to the United States.

A public and fair trial is a nightmare for Khalid and any other terrorist organization.

Q. Why would Khalid now plead guilty in a Military tribunal?
A. To obtain an invalid conviction, water boarding or false confession, and use the injustice for propaganda and recruitment.
A. Being martyred and the enticement of being martyred for recruitment.

Capital Punishment

I don't believe in capital punishment because there have been too many wrongful convictions and it is very expensive.

When it comes to terrorists, it martyrs them, instead of being locked up somewhere and forgotten.

Being Martyred is an incentive to commit a terrorist act.

Being locked up and forgotten does not create an incentive.

War

Using the term war, war on terror, war on crime, war on poverty, war on global warming etc. Does not a legal war make.
