oil companies pay gas tax

what makes the most sense to me is to have the OIL COMPANIES pay the gas tax, except...

instead of charging a flat tax, the tax should be a certain percentage of the price they charge per gallon of gasoline.
if shell wants to charge $5.00/gallon, then they pay 10-15% of the price.
maybe it would make more sense to have a minimum. anything at or below $3/gallon is 10%, and every extra dollar is another 5% increase.
